SINGAPORE LAW SOCIETY VS GOPALAN NAIR/ DISCIPLINARY PROCEEDINGS
Dear Ms Audrey Lim,
1. I refer to your 3 letters dated Oct 08, 2009, in which you state Disciplinary Proceedings have been commenced against me, under Rule 6 of the Singapore Legal Profession (Disciplinary Proceedings) Rules 2008; a reference is made to Section 90(1) of the Singapore Legal Profession Act; you state a tribunal has been set up to hear a complaint against me; the names of the 2 gentlemen who are going to adjudicate the matter and an enquiry to me as to who my lawyer is.
2. You have also attached a bundle of papers named “statement of case” and another as “Affidavit”.
3. As you are aware, I intend to represent myself.
4. In normal common law jurisprudence, of which Singapore claims to be one, it is a legal requirement that the Defendant be appraised not only of the charges against him, but also how he is required to respond and the basic procedures that apply to it.
5. I live in Northern California and have not lived in Singapore since 1991. Neither have I practiced law there ever since. I am of course practicing law in California, which you can expect has a completely different set of rules, laws and procedures. Further, America is a democracy which respects fundamental human rights.
6. Although I am able to retrieve the Singapore statutes online from California, such as the Singapore Legal Profession Act, I have no access to what you call the Singapore Legal Profession (Disciplinary Proceedings) Rules 2008 or do I have any idea what in Heavens is Section 90(1) which you refer to.
7. Let me point out that regardless of whether one has access to the legal literature or not, it is a normal practice and a requirement under the principle of natural justice that the opponent be given a meaningful opportunity to respond. That means he is told, when charges are laid, how many days he has to respond and to whom does he respond. As an example, the Summons filed and served in California courts is accompanied with a notice to the Defendant that he has 30 days to respond and to whom does he do it. This is not only a legal requirement, it is also common decency.
8. Furthermore as I live in California, I have no access to Singapore legal publications, and I have no way to check up the particular set of Rules that you mention or any other laws that pertain to this case.
9. Second, of course I can come to Singapore personally to do the necessary research and defend myself in these proceedings but I am sure you can see the problem with that. According to your charges, since my return to California, I have not only offended Judge Judith Prakash for calling her a Kangaroo Judge among other things, for which I have been now charged, I have deliberately defied your Judge Leslie Chew’s court order to take down certain blog posts by putting them up again and retracting my apology which I was coerced to give while within Singapore and in chains! This means the real possibility that I will be arrested the moment Singapore Airlines SQ1 lands at Changi International, provided that is the airline I take, in Singapore having departed Taipei! A most unwise decision.
10. But I assure you that I intend to defend these charges in earnest. It will be doing a great service to the public at large to weigh the issues, balance the merits and decide not only whether I deserve to be punished, it will be a golden opportunity to see the Singapore legal system and their administration of justice first hand.
11. The 2 cases that are the subject of these proceedings, one being the disorderly conduct and abusing Singapore police officers case; the other being the insult of Judge Belinda Ang case. The Belinda Ang case took about 8 days in the High Court and the disorderly case took about 18 days in the Subordinate Court. You will appreciate that in order to challenge these disciplinary proceedings for the Judge Belinda Ang case, it is necessary for me to have the entire transcripts of the testimony in court. Similarly for the 18 day subordinate Court case. Without the transcripts, the accuracy of what I will say about it would be compromised. In the circumstances, if you intend to give me a fair opportunity to defend myself, I ask the following:
a. Please let me have the entire transcripts of the proceedings that took place in the Subordinate Court for full 18 days before Judge James Leong. I was given none.
b. Second, although I was given some transcripts of the High Court Belinda Ang matter, I did not receive all of them, due to my sudden repatriation from Singapore and the High Court claiming that those transcripts were yet to be typed. Kindly provide all the missing transcripts.
c. Please provide copies of the Rules that you mention and any other information necessary on the procedure that Singaporean disciplinary tribunals and parties have to adopt in such proceedings.
d. Please provide all time lines for filing the responses.
e. Once the above is provided, let me have 30 days to prepare for the necessary defense.
f. Please provide your Email address and telephone number.
g. If you do this no one could say that you had not given me an opportunity to be heard, which they would if you ignore this reasonable request.
h. I trust you understand that merely asking me for the name of my lawyer is not enough.
12. Requiring me to defend these charges is like asking a VFR pilot to fly under IFR conditions in total darkness, blind with a malfunctioning altimeter, horizon indicator and a blocked pitot tube!

I will be posting in this blog, the papers that have been mailed to me by Singapore Law Society in the disciplinary proceedings against me. As you can see, the Singapore authorities are reading this blog carefully and they know it's contents. Just to make sure they don't try to avoid the obvious, I am sending this letter to them by mail as well today.

Thank you for your letter dated Oct 8, 2009 informing me that a disciplinary tribunal has been set up to hear charges against me, that Mr. Toh Kian Sing , Singapore's Senior Counsel (defines a senior Singapore lawyer) and Mr. Tan Jee Ming, Advocate and Solicitor (the name for Singapore lawyers) are the members of this tribunal.
You have also asked me for the name of my lawyer. I will not be appointing a lawyer and will represent myself.
Earlier newspaper reports from Singapore's state controlled press had, while reporting on this case, said that "I will be invited to attend the hearing".
When I was repatriated from Singapore with my American passport last year, I was specifically informed by Singaporean Immigration Officers that I can no longer enter Singapore without a visa, that I would have to receive your government's permission in writing, which I assume is a visa, before I can enter the country. (Ordinarily US citizens are allowed to enter without a visa)
Since I was born there, it would be good if I can come to Singapore once more on a short visit, and look up some of my friends and visit the places I used to frequent as a boy; while I take care of this disciplinary matter as well.
Please let me know whether I have an opportunity to represent myself in these proceedings and will your Singapore Immigration Authorities give me a visa for this purpose.

It is the same old thing about my convictions in that island last year for "insulting" Belinda Ang, the "disorderly" case and a new one they have added, about my blog post since my return to California in November 2008, criticizing Judge Judith Prakash calling her a Kangaroo Judge on what has now been generally known as the "the Kangaroo T shirt case".
Not that I had any doubt about it before. They are reading every word I write here. That is good. At least they can't pretend not to know what I think of them.
It is going to be fun.
I am sure this Singapore government is boiling with rage to read that I say "it is going to be fun!" What a sorry state to be in for a government.

Singapore's periodical reports of grandeur in their State controlled press.
Ladies and Gentlemen,
Is it time for reckoning? Let's look at all the grandiose plans of Lee Kuan Yew, son and their side kicks.
Recently K Shanmugam, Lee Kuan Yew's handpicked Law Minister had hoped for it to be a world class legal hub, as are London and New York. To accommodate it, they had built world class offices and courtrooms to rival the most modern in the world. But with the International Bar Association recently calling Singapore's legal system a third class corruption riddled system, all the hopes of K Shanmugam appear dashed.
Also on the same topic, in order to alleviate the extreme shortage of lawyers, he was reported to have come up with various novel ideas, one of which was to shorten the training period of foreign lawyers to practice in Singapore. Apart from the fact that it was hardly novel, being nothing more than allowing under qualified lawyers in, can we ask him if any lawyers have come and if so, how many? Knowing how Singapore's state controlled newspapers would splash headlines of any news that was even remotely positive, not having read anything recently in it, confirms my belief that no one has come.
So much for K Shanmugam, Lee Kuan Yew's handpicked Minister of Law and his visions of grandeur for the Singapore legal profession. Could we also ask him how many lawyers actually practice in the island of his with 5 million people now? 3,000?
Then we have heard the government asking Singaporeans to have more babies, as the reproduction rate is below replacement level meaning, without the huge influx of non English speaking foreigners from the Communist People's Republic of China, Singapore's population would have declined and there would be no one left! So Lee Kuan Yew, has the reproduction rate increased? Has the generous tax incentives for children helped? I guess not.
And then there was the language problem with Singaporeans speaking an unintelligible form of language called Singlish, a cross between Hokkien Chinese and English. Very painful to the ear for anyone from elsewhere. Lee Kuan Yew held one of his various periodical campaigns to correct the problem, this time "Speak Good English". Do they now speak any English? Or is it still horrible sounding Singlish?
And then the problem with people not getting married with Iswaran and Vivian, Lee Kuan Yew's million dollar ministers standing at train stations matchmaking, or attempting to match make I don't know which. Well are they getting married? I guess not.
And then you had the emigration problem with 2 out of 3 overseas Singapore students not returning and families emigrating enmasse to Australia and Canada. Well has the exodus stopped and are they all coming back? Once again, I guess not.
And then you had the troublemaker Gopalan Nair coming to Singapore and criticizing his (Lee Kuan Yew's) judge Belinda Ang Saw Ean for "prostituting herself as a judge into becoming nothing more than an employee of Lee Kuan Yew and son, in court". Well, he was put in jail in the hope that he will stop criticizing. But has he? It appears not.
And now Lee Kuan Yew has threatened to commence a "2 man tribunal" (odd choice of words indeed) to discipline him and to disbar him. Well, I suppose it was hoped that he would go away quietly. But no, he refuses to roll over.
But we must admit success when we see it. Lee Kuan Yew has successfully managed to attract hundreds and thousands of Chinese non-English speakers to replace the lost Singaporeans. Well, success indeed. If in fact you are trying to transform Singapore into Hubei. Sorry for the Ramasamys of Serangoon Road and Ahamd Dauds of Lorong 2 Geylang Serai. As for them, they can just disappear. Here comes the new Chinese city with the new Mandarin speakers.
With the Tamil, K Shanmugam, Lee Kuan Yew's student, the Minister for Law running the Singapore law ministry. What an island!

I finally got to thinking it over and am seriously considering defaulting on national service and heading over to the states. Only, what would the US officials be inclined to do if they do happen to find out that I bailed on national service? Would they have to deport me?
What status can I claim as a conscious objector? I read the universal declaration of human rights article 4 (regarding servitude), article 14 on (everyone having rights to asylum from persecution-of Males in Singapore through conscription) and finally article 2, which says there should be no distinction made on the basis of international status of a country or a territory to which a person belongs to. Please advice.

Thanks for your Email. Unfortunately avoidance of National Service is not a reason for asylum. However there are many other reasons you can use to get asylum from Singapore. When you reach the United States, please contact me.

Human rights groups usually are successful in attracting world attention when speaking out against dictators who are directly or indirectly involved with deaths of their citizens. However, in Singapore , LKY described as 'intelligent dictator' by Safire who died recently, of course with scarsm, is not addressed in the same manner as other dictators who had blood on their hands.
The approach to LKY had to be different. Firstly, restriction of one rights to express without fear , is like depriving a human his oxygen , which we all know is a prerequiste to be alive. So Singapore laws, like defamation suits against the opposition during election rallies, should be looked upon as criminal and threatening to the defendants and LKY should be treated on same level as dictators who are responsible for deaths of their citizens. In both scenario, citizens/ defendants suffer slow painful deaths through loss of their lives or deprivation of income which is what makes $ingapore tick. LKY knowing this well, would not want to attract world attention. Respectable figures who had to run for their lives from singapore are eg

Singapore's online edition of the state controlled newspaper of Sept 30, 2009 has this story, "Spinning tales to teach values".
This state controlled paper's book publishing section has published for sale to children of 7 years and above the book "Eureka" which is being sold at a government subsidized rate of $10.00 per book.
The book is intended to inspire in children in Singapore, according to the newspaper article, qualities such as resilience, determination and optimism. To achieve that objective it contains stories of great innovators such as aircraft inventors Wright Brothers, Ferdinand Magellan, the explorer, chemist physicist Marie Curie and so on.
But understandably, if you knew Singapore, world famous men such as Mahatma Gandhi, Nelson Mandela, Burma's Political Dissident Aung San Suu Kwi are glaringly left out. Although intended for Singapore children, not a single Singapore leader is mentioned, such as Singapore's Lim Chin Siong who spent decades in jail fighting for Singaporeans human rights, similarly for Chia Thye Poh who spent even longer time than Nelson Mandela in prison, JB Jeyaretnam who was repeatedly bankrupted by Lee Kuan Yew and today, Dr. Chee Soon Juan who has sacrificed everything for the rights of Singaporeans.
Surely if you want to instill the qualities of resilience, determination and optimism, should not the Singapore establishment have started with Singapore's home grown heroes like those mentioned above who have fought Lee Kuan Yew's tryanny against all odds before anyone else?
Surely you know the reason why there is no mention of any of these Singapore's heroes. Lee Kuan Yew does not want the children of Singapore to have the qualities of resilience, determination and optimism that JB Jeyaretnam or Chia Thye Poh had, for it may nurture rebellion and opposition to his dictatorship. Best that they forget men such as Chia Thye Poh and think only of inventors such as the Wright Brothers, since the Wright Brothers can do no harm to Lee Kuan Yew's dictatorship.
What a coward Lee Kuan Yew is to resort to brainwashing young children. The result of this exercise is of course this. Parents who can see what I see, will sooner than not, transport themselves and their children to Western countries to avoid the brainwashing. Those who do not see this, or are unable to emigrate for one reason or another will subject their children to this; resulting in the less capable populating the island and the bright and capable ones having gone elsewhere in the world.
It only goes to exacerbate the burning problem of the brain drain from the island and with Singapore lacking talent. The 86 year old Singapore tyrant and octogenarian Lee Kuan Yew who is kept alive on drugs and modern medical devises loses every way.
